Terms of Service Agreement
Welcome Kodecrew (the "Application"), owned and operated by Kodebaze (the "Company"). These terms and conditions (the "Terms of Service" or "Agreement") govern your use of the Application and its associated services, features, and content (collectively, the "Services"). By using the Application or the Services, you agree to be bound by these Terms of Service, as well as the Company's Privacy Policy, which is incorporated herein by reference.
Use of the Application The Application is provided solely for your personal, non-commercial use. You may not use the Application for any other purpose without the express written consent of the Company. You agree to use the Application in compliance with all applicable laws, rules, and regulations.
User Accounts In order to access certain features of the Application, you may be required to create an account. You agree to provide accurate, complete, and up-to-date information when creating your account, and to promptly update your account information as necessary. You are responsible for maintaining the confidentiality of your account login credentials, and for all activities that occur under your account.
User Content The Application may allow you to submit or upload content, such as text, images, and other materials (collectively, "User Content"). You retain all ownership rights in your User Content, but you grant the Company a non-exclusive, royalty-free, worldwide, transferable, and sublicensable license to use, copy, modify, distribute, publish, and process your User Content for any purpose, including but not limited to the operation of the Application and the provision of the Services. You represent and warrant that you have all necessary rights to grant the foregoing license to the Company, and that your User Content does not infringe or violate the rights of any third party.
Prohibited Conduct You agree not to use the Application or the Services to:
a. Violate any applicable law, rule, or regulation; b. Infringe the rights of any third party, including but not limited to intellectual property rights, privacy rights, and publicity rights; c. Transmit any viruses, worms, or other harmful software; d. Interfere with the operation of the Application or the Services, or with any other user's use of the Application or the Services; e. Attempt to gain unauthorized access to any part of the Application or the Services; or f. Engage in any other conduct that the Company, in its sole discretion, determines to be inappropriate or harmful to the Application or the Services.
Termination The Company may terminate your access to the Application or the Services at any time, with or without cause, without notice or liability to you. Upon termination, all rights granted to you under these Terms of Service will immediately cease.
Disclaimer of Warranties THE APPLICATION AND THE SERVICES ARE PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE COMPANY DOES NOT WARRANT THAT THE APPLICATION OR THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Limitation of Liability IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APPLICATION OR THE SERVICES, EVEN IF THE COMPANY HAS BEEN ADVISED OF
